In pursuance to my being appointed as part of the Subcommittee on the South, I feel deeply appreciated for that. In the past four years of working with the Working Group on Justice for Peace (WGJP) to address human rights issues in the Deep South, I find the issues there highly complicated. A number of people have been treated unjustly, have their rights violated and been subjected to gross discrimination. Many of them are women and children, and even the Buddhists minority. <\/p>\n
Judging from the letter of appointment with the list of members in the Subcommittee, to me, the Subcommittee\u2019s memberships are confined to just human rights advocates including those working on rights and liberty in life and body and justice. None of them have had experience working with issues concerning children, women or minorities. In addition, a half of the members come from the same organization, or organizations working closely with each other. It tends to given them domination over the rest of the committee members. As a result, it might compromise the ability of other committee members to act independently in protection of all citizenry groups in the Southern border provinces, as provided for by the 2007 Constitution.

\nAlso, several members in the current Subcommittee on the South were members of the Subcommittee against Torture appointed during the previous NHRC. Their lack of impartiality has already been subjected to concerns raised by security officials working in the Southern border provinces. Against conflict of interest, it is also improper to appoint them in the new subcommittee again since they can be both the complainant of the case and the inquirer at the same time. It appears that some members in the subcommittee have previously made attempts to investigate the implementation of governmental officials using their NGO status. But when they were rejected by concerned officials, they decided to use their status in the Subcommittee to persist on their investigation. It has simply given rise to confusion, a lack of trust and credibility in the NHRC Subcommittee as far as its impartiality is concerned. <\/p>\n
As widely known, the current NHRC has been subjected to questions raised by many human rights organizations inside and outside the country as to a lack of experience and understanding in human rights issues among certain NHRC members. Their integrity and ability has also been questioned by the Asian NGOs Network on National Human Rights Institutions (ANNI), a network of organisations monitoring and assessing the performance of NHRIs in Asia. In 2008, the ANNI had submitted a report in 2008 to the Sub-Committee on Accreditation of the International Coordinating Committee of National Institutions for the Promotion and Protection of Human Rights (ICC) for the accreditation review of the National Human Rights Commission of Thailand. As a result of that review, in November 2008, the ICC Sub-Committee on Accreditation made several recommendations to the NHRCT. One of these recommendations was that there is a need for a broad consultation in the nomination and selection of Commission members, including with civil society and vulnerable groups. The ICC Sub-Committee on Accreditation referred the NHRCT to its General Observation 2.1, where it stated that one of the ways by which to achieve pluralism in conformity with the Paris Principles is through pluralism in procedures enabling effective cooperation with diverse societal groups, for example advisory committees, networks, etc.; or in this case, the Subcommittee on the South. <\/p>\n
With deepest concern as explained above, I would like to call on you to reconsider the appointment of the current Subcommittee on the South. Efforts should be made to ensure fair representation of all sectors in the Subcommittee and to guarantee that it can deliver to protect rights and liberties of all groups effectively and in accordance with the spirit of the law to enact NHRC and Thailand\u2019s Constitution. <\/p>\n
